Delta State____ It is chagrin to avow that more than 20,000 people have been sacked by the ravaging flood in the riverine communities. Many residents in Burutu, Bomadi, Patani, Warri south west, Warri North local government area respectively fled their homes due to continuous heavy down pour over the past few weeks.

These flood victims suffers this fate every year. Only God knows when this calamity will end! Furthermore, people are now homeless, properties destroyed, schools closes down(flood break), high death rate due to water borne diseases like cholera, snake bite, colossal disruption of business activities, destruction of crops, farm lands, houses, among others.

It is not contrivance that God created them in coastal region or not a crime to own her fatherland in the riverine area. I'm calling on Dr Ifeanyi Okowa to urgently address the needs of the flood displaced people. Establish FDP Camps and financial support to them, because affected individuals need food, shelter assistance provision of health services, drinking water and access to clean toilets. Household items have also been damaged. Most vulnerable are women, children under five, elderly persons, and persons with disabilities.

I'm also calling on legislators representing riverine communities to sponsor bills containing the permanent creation of FDP Camps, with yearly budget to rehabilitate flood displaced people's.

Abuja___ The alleged plot to unseat Vice President Yemi Osinbajo continues to thicken with each passing day. Fresh reports have emerged that the alleged Northern Cabals do not consider VP Osinbajo a true ally of President Buhari because of his loyalty to APC Chieftain, Bola Tinubu, hence, contenders such as Fashola, the Honourable Minister of Works and Housing and Governor Kayode Fayemi of Ekiti state are the political top guns considered to take over as Vice-President of Nigeria.

The VP who has been roped into different political controversies in the past weeks from disbandment of Economic Management Team which he chaired, to the N90 billion alleged FIRS scam, may be forced out of Aso Rock in the long run. As these are all political gimmicks with an endgame, that will most likely have Osinbajo get unseated as Vice President.

A credible source in the Presidency, who spoke on the condition of anonymity to Daily Independent disclosed that, the alleged Cabals are not comfortable with having Tinubu’s right hand man as No. 2 in Nigeria, they would rather have someone who is a true,tested and trusted ally as Vice-President. The cabals who still consider South West zone as the primary zone to produce the No. 2, are considering Minister Fashola and Governor Fayemi of Ekiti state.

Buhari is said to harbour a special kind of admiration and respect for Babatunde Fashola, so much that Buhari wanted him as running mate in 2015 but Religious barrier would have been a major obstacle as they are both Muslims. This was why Buhari entrusted him with the three most important ministries in Nigeria during his first tenure. Fashola was the Minister of Works, Power and Housing. He had all three important portfolios to himself.

The President is also very comfortable with Fashola and would have picked him as his running mate in 2015 but for the outcry against a Muslim-Muslim ticket which also jeopardised Tinubu’s chances.
If you remember, that was why the president appointed Fashola as the Minister of Power, Works and Housing in 2015, making him the most important minister in his cabinet or super-minister as many called it.

Governor Kayode Fayemi is also a very possible candidate that could emerge as Vice-President following the key role he played as Chairman of the Presidential Convention Committee of the All Progressives Congress (APC), which was responsible for producing President Buhari as the Presidential flag bearer of the party in the party’s 2015 Primary elections.

Fayemi was so loved by Buhari that he was appointed the Minister of Solid Minerals Development until he resigned on May 30 ,2018, to contest in the Ekiti state governorship election.
Now that the Northern Cabal still wants the South West to retain the position of Nigeria’s No. 2, Fayemi and Fashola are the main contenders, being considered.

Niger Delta____   According to the Ijaw Youth Council (IYC) President, Barr. Pereotubo Oweilaemi, We have been reliably informed that there are clandestine moves by power players within the corridor of power at the presidency to abruptly terminate the Presidential Amnesty Programme. The move, if materialised by the enemies of peace, will be viewed as ethnophobic propensity of the present Government against the Niger Delta people.

Speaking with newsmen, the IYC, President, and President of all the ethnic Nationality Presidents of the Niger Delta, Barr. Pereotubo Oweilaemi said, “If the move  materialised by the enemies of peace, the Niger Delta will take it as ethnophobic propensity of the present Government against the Niger Delta people. From public records, this present government grant Amnesty to killers of Boko Haram and Fulani herdsmen that killing innocent citizens of the country.

In case the plotters of the evil coup fail to know, the Amnesty Programme is a mutual agreement between the Federal Government of Nigeria and the Niger Delta people. The bargain is for the agitators to lay down their arms to accept the offer of Presidential Amnesty which has hitherto outlined terms and conditions to be complied with by both sides.

The Amnesty Programme is a well thought out developmental programme of the then government of late President Omaru Musa Yar'Adua with different segments. The Programme was phased into three segments which are: Disarmament, Demobilisation and Reintegration for the first segment; Rehabilitation for the second segment while Strategic Implementation Work Plan (SIWP) for the third segment.

Granted that the first segment has successfully been carried out. However, we are still at the second segment which is the rehabilitation process. Engaging the youths on vocational trainings or sending people to school as well as the empowerment programmes are all part of the rehabilitation processes.

There is no time limit as to when the Programme will be terminated especially when all the segments have not been executed. The third phase has not been attended to which is strictly for the massive development of the region. None of the developmental master plans initiated in the Programme has not been implemented.

Where is the N1.5trn Coastal Highway already awarded before Yar'Adua's unfortunate death in 2009? What about the East West Road which is now abandoned by this present Government? What about the Federal Government, Multinational Oil Companies and Private Sectors tripartite agreement to massively develop the riverine communities which was duly incorporated in the Amnesty offer?

The agitators did not accept the Amnesty offer simply because they agreed to be paid N56,000 for a period of time. May we remind those in Government to check their records? The first meeting between the top echelons of the Niger Delta freedom fighters and late president Omaru Musa Yar'Adua which had heralded the smooth kick off of the Amnesty Programme, the agitators tabled their demands to Yar'Adua who beat his chest that he will not disappoint the Niger Delta people. All terms and conditions discussed in that meeting were documented by the Federal Government and they formed part of the Amnesty Programme.

The Government has not fulfilled its own part of the bargain since the boys have laid down their arms for oil to flow freely into the nation's coffer. Terminating the Amnesty Programme without fulfilling the conditions stated therein is a breach of trust and agreement and it cannot go scot free without being visited with dare consequences.

The world is watching us. Niger Delta crisis is a global issue. This was the reason why the agitators had earlier insisted that they want UN representatives to witness the truce. People should not pursue personal ambition to endanger the corporate existence of Nigeria. We hope that Niger Delta people will not be blamed for any breakdown of law and order. Let us be wary of our actions. Less we will jeopardize our corporate coexistence.

Ebi Pinapinawei, popularly known as Commander Biggy alongside his 3,000 soldiers has declared his intention to support and work for the APC candidate, Chief David Lyon for Governor of Bayelsa State.

Commander Biggy who is the founder/CEO ' Biggy Foundation' was a PDP staunch made the declaration yesterday 27th September, 2019 in Abuja, after consulting with some critical stakeholders and leaders from Bayelsa State noted that, he had worked for PDP in the past 19years, but there is nothing to show for his hard work and contributions for the party. He said change is constant and that there is an open ground for him and his boys to join force with APC in order to deliver David Lyon.

According to the Ekeni Southern Ijaw born freedom fighter, said he believes that David Lyon is the right man to deliver Bayelsans from the hands of Pharaoh,  stressing that he will make Bayelsa a better state for everybody.

This statement was made by Destiny_ Onadigha Perewari and Yanki Sylvester, "we are students' of the Nigerian Law school under the presidential Amnesty Programme, six(6) months down the line the office has refused to pay some of us our school fees and training allowances"

"He made a selective payment and deliberately refused to pay some of us. How can a Professor who should be promoting the course of education, not concern about the education of delegates in the programme" they lamented.

Edo State____ The Benin Solidarity Movement(BSM) group has reacted to a recent statement credited to the Ijaw Peoples Development Initiative(IPDI) giving its support to an earlier threat by the Niger Delta (NDF) to attack Edo State if their demand for recognition by the state government and the Oba of Benin is not met.

In a statement signed jointly by Comrade Curtis Ugbo and Machiavelli, the BSM warned the IPDI, the self-styled Ijaw militants and their collaborators to desist from their actions or else face reprisals.

From the language used by IPDI it is obvious that some earlier statements of threats and insults directed towards Edo people, Edo State Government, Governor Obaseki and the Benin monarch which are credited to the self-styled Ijaw militants all have the support of IPDI and majority of their kinsmen," BSM stated.

According to the BSM, "for IPDI to plead with the Ijaw Creek Dragons to 'dry up their gunpowder' is a way of making them feel important but we wish to state categorically for the unspecified time that they do not have monopoly of violence.

History is awash with the exploits of great Benin warriors who go as far as other domains to unleash terror and come out victorious in battle. Pleading with the self-styled Ijaw Creek Dragons, who operate under the banner of the Niger Delta Forum, NDF, to 'dry up their gunpowder' is a needless exercise which we will tackle at the appropriate time.

It is a sad tale for the IPDI to call on Governor Obaseki 'to act fast by implementing the demands made by the Creek Dragons of Niger Delta.'

Under which authority is the nefarious NDF and the shadowy IPDI making such ridiculous demands on Governor Obaseki?
We want to know when the term 'Edo Ijaws' sneaked into the lexicon of the Ijaws living in Edo State? Does it mean that we now have 'Edo Igbo', 'Edo Yoruba', 'Edo Calabar', 'Edo Hausa', 'Edo Europeans' or even 'Bayelsa Tivs'?

The oil resources that is on Edo soil is the treasure of Edo State placed in our soil by God and for Ijaw people residing in the state to say that they produce it is absurd.
EDSOPADEC is an agency established to cater for the needs of oil producing communities in Edo State. For IPDI, NDF and their sponsors to seek to have a say in its affairs is like Benin Solidarity Movement or Arewa Consultative Forum insisting on their members being appointed on the board of the EDSOPADEC.

The IPDI, NDF and their sponsors /supporters should henceforth cease their ill-bred mannerism of challenging the authority of the Benin monarch. They should extend the kind of reverence they accord Ijaw monarchs to the Benin monarchy.

Delta State____ The Senior Special Assistant to the Governor of Delta State on Security, Comrade Ezekiel Daniel has said that journalists are Germaine to his effort at helping Governor Ifeanyi Arthur Okowa actualise effective security and peace in Delta, adding that the role of the media cannot be overemphasized.

He made this assertion Wednesday 23rd September, 2019, when he visited the NUJ Temporary Secretariat to seek journalists collaborative effort in line with the functions of his office as SSA on Security.

Ezekiel who is from Warri North and has been an activist for over 22 years, stated that he decided to connect with the media, believing that no government or its functionaries can succeed in office without the indispensable collaboration of the media.

The SSA affirmed that so far in his three weeks old appointment, he had visited some flashpoints in the state, including Onwian to hold meetings with them on the need to sustain the peace initiatives of the SMART Governor of Delta State.

He also said that he had visited Sapele Local Government Area to have on the spot assessment of the area now being largely infested by alleged Yahoo Plus criminals, maintaining that at the meeting with some youths in the area, he charged them on the need to be on the watch out for anything that impedes security and undermines peace in Sapele and Delta in general.

According to the SSA, "Since my appointment in the last three weeks, I have taken proactive steps to prove that youths are equal to effecting change in our State and country."

Realising that peace is the template for the desired progress and development, and upon which security and vigilance cannot be overlooked; based on this, we are deploying every legitimate means - Advocacy, Collaborative effort and others to bring about peace in our State."

Abuja____ Former governor of Lagos State, Senator Bola Ahmed Tinubu has reportedly sent N100m to each of the 6 geopolitical zones through his coordinators as part of mobilization for logistics to kick off skeletal work for his Presidential bid.

Asiwaju Tinubu is not leaving any chances in scaling up his campaign, after getting a wind of the plan of his protege, Vice President Prof Yemi Osinbajo of nursing Presidential ambition in 2023.

We learnt that Tinubu will start serious funding of his campaign structures across the country when the coast becomes clearer for him to clinch the ticket under APC, else, alternative will be activated, the alternative which includes running on another platform, that is the main reason he is starting the building of a mirror structure on time in case APC failed, so that he can use his nation wide alternative structures to kick off.

Investigator says that Lagos State government under Sanwoolu has not been able to carry out major projects since assuming office in May 29 because funds meant for the development of the State may have been mopped up for the Presidential ambition of Asiwaju Tinubu, the godfather of the governor, causing slowness of his administration.

We also learnt that Sanwoolu is threading with caution, not to offend Tinubu like Ex Governor Akinwunmi Ambode, as information within Lagos APC suggests that he (Sanwoolu) may only run for one term, while Tinubu's son Seyi Tinubu may likely take over from Sanwoolu in 2023 in case all roads becomes blocked that Tinubu cannot make it at Presidential election, to at least compensate him.

Vice President Osinbajo has come under serious and strategic attacks from those he called fifth columnist, working to undermine the work of President Buhari which he is also a prominent actor.

A chieftain of the APC accused VP Osinbajo of pilling up funds through agencies under him for his Presidential campaign ahead of 2023, in the same vein called Osinbajo President of "Yahoo Boys", Osinbajo has been going from one state to another,sharing N10,000 to market women and traders in what they branded as TraderMoni and MarketMoni, but that Osinbajo cannot account for all the money assigned to him for the assignment.

President Buhari last week puts together another economic team different from the one being managed by Osinbajo, some agencies under him were also recovered and handed over to others, but Osinbajo aides have been in the media making frantic effort to defend him.

Comrade Timi Frank, a former chieftain of the APC alleged that Osinbajo received N90billion from FIRS under Babatunde Fowler for strategic use in the six South West States prior to the 2019 elections. A Presidential source hinted that Osinbajo could not account for how the funds was appropriated. Osinbajo, a Pastor in RCCG could not wash off his hands from the allegation publicly.

When Senator Bola Tinubu and Chief Bisi Akande reportedly met with Buhari at the Presidential villa, they both took divergent stands when required to prevail on Osinbajo to step down. While Akande opposed VP stepping down, Tinubu was of the opinion that Osinbajo should step down if found wanting, this stand or tone may not be unconnected to his Presidential ambition.

Since series of information began to hit the public on the names of the people in the Presidential race, Tinubu has come under serious tension, which has caused him to start immediate funding of his men in all the geopolitical zones to start work, the first funding was meant to set up structures, while the main funding is being expected any moment.

Tinubu's number one challenger within APC, Nasir Elrufai who is of the opinion that APC should jettison zoning or rotation, is arguing that the North should retain power in 2023, Tweeted this in what he called SATURDAY WISDOM: “The moment the masquerade begins to think he is the God, the masquerade will be unmasked and reduced to be a laughing stock that is lower than a human being.” - Yoruba Proverb.

Tongues have been wagging over who the Governor of Kaduna was referring to, and why he chose to use Yoruba Proverb, maybe to appropriately point to the direction of the owner of his tweet.

As Tinubu, Elrufai and Oshiomole's campaign posters flooded the streets, just when the second term of President Buhari is not even up to one year, the drama keeps unfolding within APC, on the other hand, PDP Presidential candidate, Alhaji Atiku Abubakar and his party are headed to the Supreme Court to challenge the verdict of the appeal court which affirmed Buhari as the winner.

Lagos – Dr. Emeka C. Kalu, a Peoples Democratic Party (PDP) chieftain and National Director (Special Duties), PDP Youth Alliance (PDPYA), has made case for an independent judiciary, if that arm of government would continue to enjoy the confidence of Nigerians.

He stated this against the backdrop of plans by Abubakar Atiku, his party’s presidential candidate in the last election, to approach the Supreme Court after losing to President Muhammadu Buhari at the Presidential Election Tribunal.

Kalu, also the Director General (DG), Global Initiative for Good Governance (GIGG), in a statement on Monday signed by Comrade Amos Kalu, his media and publicity aide, maintained that Nigerians must not lose confidence in the country’s judicial system as it had remained the only hope for the protection of lives, rights, and freedom of the common man against what he termed the brutality and nakedness of power.

The PDP chieftain and Director General of Atikulated Agenda Worldwide, described an independent judiciary as the only way balance could be achieved in a sane society for the good of the leaders and the led.

He said: “We must not lose confidence in the ability of the judicial system of our dear nation. We are all humans and we are prone to errors, when error occurs, we shouldn’t over rule every possibility of correction and we are of high belief that the Supreme Court will do all it must to restore the confidence and belief of the people in the judicial system of our dear nation.

“Alhaji Atiku Abubakar and his teeming supporters have exhibited high level of maturity and belief in the judiciary to adjudicate justice and I am optimistic that justice will at the end take its full course in Nigeria.

“He has continued to call on his supporters to be patient and wait on the law. I think this is the highest display of civil responsibility from a foreknown democrat like Alhaji Atiku. It is very commendable.”

He appealed to the judiciary as ably represented by the Supreme Court, to reciprocate to the goodwill of Nigerians who had been seeking for nothing, but justice for all.

“Our laws and interpretation should not be based on technicalities. Rather, it should be based on rules of evidence. This was substantial enough before our learned justices gave us a shock of our lives. It is now incumbent on the Supreme Court to upturn the mistake and set the record straight for posterity’s sake.”

Abuja_____ Sources revealed that some senators, goaded by some forces in the villa, are gearing to dust up the report of the House of Representatives Committee which investigated the illicit financial  activities within NEMA, amounting to N33bn when Osinbajo acted as President in 2017. Coincidentally Osinbajo is also chairman of the governing board of NEMA.The Senate is expected to resume on Tuesday September 24.

Indications that the presidency was displeased with Osinbajo emerged when a memo by the President mandating him to henceforth take directives from the President in the management of agencies and parastatals he was constitutionally empowered to oversee, a move many interpreted as whittling the influence of the vice president.

This action on the Vice president comes at a time the President formed the Economic Advisory Council with a mandate to report directly to him which in effect disbands the Economic Management Team, hitherto under the supervision of Osinbajo.
Osinbajo chairs the governing boards of the National Emergency Management Agency (NEMA), the National Boundary Commission (NBC) and the Border Communities Development Agency (BCDA).

He is also the chairman of the board of directors of the Niger Delta Power Holding Company (NDPHC), a limited liability company owned by the three tiers of government.

The vice-president also chairs the National Economic Council (NEC), a constitutional body made up of state governors and key federal government officials, as well as the National Council on Privatisation (NCP).

However, the source revealed that some senators have been prepped to kick start the process of Osinbajo’s sack on the grounds of the House of Representatives report on the sleaze in the management of intervention fund during Osinbajo’s tenure acting president.

The House of Representatives had in 2018 investigated the illicit activities in the administration of intervention funds by the National Emergency Management Agency (NEMA) under the supervision of the Osinbajo.

The investigation was sequel to
House plenary resolution on February 15, 2018 which mandated it’s Committee on Emergency and Disaster Preparedness to investigate the alleged “Violation of Public Trust in National Emergency Management Agency (NEMA)”

The Committee adopted the following terms of reference to determine the propriety or otherwise of the transactions undertaken and expenditures incurred in the following areas of concern by management of NEMA.

“(i) The release of N5,865,671,389.26 and N3,153,000,000.00 as emergency intervention of Food Security to support the population affected by insurgency in the North-East in June 2017 and other releases for the North-East intervention;
“(ii) The 6,779 metric tons of rice donated by Chinese government to the internally displaced persons in the North-East;
“(iii) Payment of about N800 Million Demurrage on the donated Rice by the Chinese government;
“(iiii) Over 10 Billion Naira being statutory 20% Ecological Funds released between January 2017 to February 2018 to NEMA;
“(v) The Federal Government of Nigeria Flood Intervention in the sum of N1,600,000,000.00 to 16 States in July 2017;
“(vi) The over N1.6 Billion released to NEMA for Evacuation of Nigerians stranded in Libya in 2017; and
“(vii) Other ancillary issues,” the report made available to Point blank news revealed.

According to the report, the House Committee conducted the investigation over a period of three months in 11 Public Sitting with various stakeholders.

Invited stakeholders who made presentations at the hearing were from: (i) The National Emergency Management Agency (NEMA)
(ii) Office of the Accountant General of the Federation, (iii) Federal Ministry of Finance, (iiii) Central Bank of Nigeria
(v) Federal Ministry of Budget and National Planning, (vi) Federal Ministry of Agriculture, (vii) Economic and Financial Crimes Commission,(viii) Governing Council of NEMA.

Contractors invited and made presentations include – Dangote Rice Ltd, BUA, WACOT, Golden Agric Input Ltd., Olam Nig. Ltd., 3 Brothers Nig. Ltd.

Other who made presentations were (x) Office of Head of Service of the Federation, (xi) The Nigeria Customs Service, (xii) Nigeria Port Authority, (xiii) MAESK Line Clearing and Forwarding Agents & Transporters,
(xiiii) APMT & Maresk Line Clearing Agents & Transporter, (xv) SEMA
(16 states affected by the flood and 5 out of the 6 states of the North East),
(xvi) CAC, (xvii) PENCOM, (xviii) FIRS
(xix) ITF, (xx) NSITF.

The report revealed damning illict transactions that happened in the emergency agency with intervention fund.

Finding on the donation of 6,779 Metric tons of rice by the Chinese government for IDPs in the North east,  the House Committee said,
“– That the Chinese government donated and shipped a total of 6,779 metric tons of rice, that is 271 trucks and approximately 162,696 bags of rice into the country’s seaport in June 2017 meant for distribution to IDPs in the North-East as food assistance.
“–   That the government Agencies namely – Ministry of Budget and National Planning, Ministry of Agriculture, Ministry of Finance and NEMA were charged with different responsibilities of receiving, clearing, storage, transportation and distribution of the consignments to the IDP’s in the North East.
“–     That more than one year after the goods were donated, there is no evidence that the 6 States of the North East, who are the beneficiaries have received the items.
“–   Evaluation of the correspondences by the Chinese government on the free donation of the items and responses by the Federal government Agencies confirmed that there was adequate information on the donation, as an Memorandum of Understanding (MOU) was entered into by all the parties indicating the role to be played by each Agency. But the rice could not be evacuated over long period of time at the seaport despite written letters by Chinese Government to Ministry of Budget and National Planning after an import waiver had been obtained from Ministry of Finance, informing the Nigerian authorities of the consequences of the delay in clearing the items.
“–   The Federal Government paid about N800 Million as demurrage to APM terminal and Maersk Line for the consignment due to delay arising from inability and negligence on part of NEMA, Ministry of Agriculture, Ministry of Finance and Ministry of Budget and National Planning to secure the items as at when due.
“–     APM Terminal provided invoices on the demurrage showing payment by Ministry of Agriculture but NEMA testified it made the payment. NEMA could not however, provide before the Committee evidence of payment to APM terminal but the payment reflected in their account book.
“–     Ministry of Budget and National Planning was to provide the funding for the clearing, transportation of the rice, handling and logistic charges as agreed in the Memorandum of Understanding signed by the Government Agencies.
“–     Ministry of Agriculture was responsible for providing silos for the storage of the rice.
“–   The Ministry of Agriculture confirmed to the Committee that no single bag of the consignments was delivered and received from NEMA as at the time of this report.
“–     Global View Logistics Ltd and Baltic Air and Maritime Services Ltd engaged to clear the rice were not registered contractors with NEMA, the Companies were equally not registered with ITF, NSITF, and PENCOM, as required by existing law, practice and Regulations.
“–     National Emergency Management Agency (NEMA) was saddled with the responsibility of delivering the consignments to different designated silos and to distribute all the 6779 metric tons of the Chinese rice to the IDPs within the 6 States in the North-East in the following proportion:

“Ministry of Finance provided Certificate for Import tax waiver with tax deduction on the consignments donated to Nigeria by Chinese government
“The 5 State governments in the North-East except Borno State who did not appear before Committee, denied receiving any single bag of rice from the consignment purported to have been delivered and distributed to the IDPs by NEMA.
“–   Due to the testimony of the Director of Finance and Accounts (DFA) and some staff of NEMA on payment of demurrage which the management was not comfortable with, NEMA management hurriedly convened a Governing Council meeting of NEMA for the first time in 3 years where it took a decision to suspend the Director of Finance and 5 other staff of the Agency without due process and in flagrant violation of the principle of fair hearing as guaranteed under Section 36 of the 1999 Constitution as amended.
“–   The suspension took place on 2nd April, 2018 which was the date of the inauguration of the Council Members by the Vice President. This was done within the period of investigation by the Committee, and intended to jeopardise and obstruct the work of the Committee.”

B. RECEIPT AND UTILIZATION OF N1.6BILLION FOR FLOOD VICTIMS IN 16 STATES
FINDINGS:
–     NEMA confirmed receiving the sum of N1.6 Billion released to it by the Federal Government as Intervention Fund to purchase food items and other relief materials for distribution to all the 16 States which was affected by the flood disaster in June 2017. The States are: Lagos, Oyo, Edo, Kwara, Ebonyi, Niger, Ekiti, Kebbi, Akwa Ibom, Plateau, Sokoto, Bayelsa, Enugu, Ondo, Abia State and FCT
–     The ratio of distribution of the fund for each State is N100,000,000.00.
– The Committee further confirmed that 11 of the States received relief items worth less than N50,000,000.00 each while 5 States received items worth N70,000,000.00 each from NEMA and only received the items in March 2018 when the investigative hearing commenced.
–     The relief materials released was an afterthought and not intended to salvage the situation as the disbursement happened 9 months after the flood disaster. Thereby defeating the emergency purpose for which it was meant.
–   NEMA could only account for the disbursement of N900 Million to the Sixteen States.  The balance of N700 Million could not be accounted for.
C. FUNDS RELEASED FOR EMERGENCY INTERVENTION OF FOOD  SECURITY IN THE NORTH-EAST
FINDINGS:
–     On the emergency intervention of food security to the North-East to support the population ravaged by insurgency, a sum of N5,865,671,939.26 was approved and released in June 2017 vide a memo raised from the Office of the Acting President, directing the Hon. Minister of Finance and the Accountant General of the Federation to so act.
The details further specified a directive to the Governor of CBN from the Ministry of Finance to pay the sum from the Consolidated Revenue Fund Account which the AGF is to raise a mandate for.This is in contravention of approval of NASS on the issuance of Euro Bond from which the Hon. Minister authorized the payment. The Euro Bond is for specified infrastructural projects and not for discretionary intervention.
Furthermore, there is no specific appropriation by the National Assembly.
This contravenes Section 80 (4) of the 1999 constitution as amended: which states:
“No money shall be withdrawn from the Consolidated Revenue Fund or any other public fund of the Federation, except in the manner prescribed by the National Assembly”.
The money was paid to the following companies for supply of food items to the North East:-
1. Dangote Rice Ltd. = N936,196,800.00
2. Golden Agric Input Ltd. = N1,384,554,236.26
3. BUA Rice Ltd. = N1,322,273,520.00
4. WACOT Ltd. = N453,674,296.00
5. WACOT Ltd = N939,946,089.00
6. NEMA = N829,026,456.00
= N5,865,671,389.26
–     Committee noted the flaws and infractions on the authorization granted and removal of such huge sum of money from the Consolidated Revenue Fund Account of the Federation in violation of section 80(2) of the Constitution, Section 16(2) of the Procurement Act and provisions of the Appropriation Act as approval of the Legislature was not sought nor obtained for such expenditure.
–   Due process was not followed as taxes and interest accruable to government were not deducted and remitted to the FIRS on the sums released and paid into the accounts of the different corporate entities shown above, this created colossal loss of revenue to the Federal Government.
No meeting of the Federal Executive Council was held approving the contracts to the named companies and the release and crediting of the funds directly into the individual companies and NEMA bank account in blatant violation of approval limit allowed by law.
–   It was revealed in the Public Hearing testimonies that Dangote Rice Ltd, WACOT Ltd, BUA Rice Ltd and Golden Agric Input Ltd had earlier received N2billion each from CBN as loan to mop up grains across the country.
– All the 6 States of the North East denied ever receiving this emergency intervention for food security in the North East for which about N5.8b was expended by the Federal Government.
–   Out of about N5.8Billion. NEMA got N829,026,456 for logistics and it claimed it spent it as follows, without satisfactory evidence:
(i) General Logistic N369.5 million
(ii) Branding and packaging N189.00 million
(iii) Others (Marketing, Security, tracking and media) N248.6 million
(iiii) Contingency N21.9 million
D. RELEASE OF N3,153,000,000.00 TO NEMA FOR FOOD INTERVENTION TO THE NORTH-EAST
FINDING:
–   The Committee noted that NEMA released 2.4 Billion Naira to Olam Nigeria Limited to supply 8,000 metric tons of rice, gave 3 Brother Rice MillLimited the contract to supply 2,000 metric tons of rice at N600,000,000 and N153,160,000 for logistics and transportation of the items, all totaling N3,153,000,000.00.
–     Committee observed that OlamNigeria Limited and 3 Brother Rice MillLimited were contacted verbally by Ministry of Agriculture to go to NEMA for the jobs without due process.
–   The contract award letters issued toOlam Nigeria Limited and 3 Brothers Rice Ltd were all signed by the Ag. Director of Relief and Rehabilitation and not by Director of Procurement in contravention of Public Procurement Act.
–   The same Ag. Director of Relief and Rehabilitation who was saddled with the responsibilities of receiving the items and distributing them, signed the award letters without the knowledge of the Procurement Department. This is tantamount to breach of the Procurement Act.
– Evidence before the Committee showed that the World Food Programme (WFP) sought to import and supply 5000 metric tons of rice to the North East, at the rate of N11,500 per bag which is cheaper than the N15,000 per bag offered by local Nigerian millers. However, the Committees findings indicate that the concerned Federal Government agencies namely Federal Ministry of Agriculture and NEMA offered to subsidise the purchase locally, at the same rate of N11,500 to World Food Programme to discourage importation and encourage local production.
– NEMA now claimed to have donated the 5000 metric tons of rice to WFP  instead of allowing WFP to purchase same and distribute to the North East. There is no evidence that the WFP received the 5000 metric tons as donation from NEMA, as the approval of N3.1billion was for NEMA to purchase the rice and distribute same to the victims of insurgency in the North East, as WFP did not provide the Committee with such evidence after repeated requests.
– Both companies, Olam Nigeria Ltd and 3 Brothers Rice Mill Ltd, were illegally contracted to carry out the supplies as their profiles showed that they had no PENCOM, FIRS, ITF and NSITF Clearance Certificates in compliance to Section 16 of the Public Procurement Act.
–   The data of 3 Brothers Rice Ltd sighted by the Committee did not tally with registration name “Three Brothers Rice Mill Ltd” approved by Corporate Affairs Commission which means NEMA gave contract to a non-existent entity.
Therefore the contract awarded to both Olam and 3 Brothers were in violation of the Procurement Act.
E.   EVACUATION OF NIGERIANS FROM LIBYA
FINDINGS
– Committee confirmed that the sum of N1.6Billion was released to NEMA for the evacuation of Nigerians stranded in Libya in year 2017.
– The Committee also discovered that contract awarded under this exercise were inflated.
– In the course of the investigations, the Director-General of NEMA, Eng. Mustapha Yunusa Maihaja, gives account of expenditure as the N1.6Billion to include evacuations, security personnel logistics and local transport.
F. UNACCOUNTED N17,889,050,401 RELEASED FROM ECOLOGICAL FUND TO NEMA
FINDINGS
– The Committee established that 20% of the Statutory Ecological funds are released to the National Emergency Management Agency on monthly basis. This is in compliance with Section 13(2B) of the NEMA Act.
– It was discovered that from January 2017 to May 2018 the total amount released and or received by NEMA is to the tune of N17Billion.
– Furthermore, NEMA incurs expenditure from the fund without going through statutory appropriation approval from the Legislative Arm of Government.

“– The Committee noted that the failure of the Governing Council of NEMA to forward the details of the amount released to it to the National Assembly for Appropriation, consideration by the Legislature and passage is a gross violation of the provisions of the Constitution.

“– Due process was also not followed by NEMA on the contract sums as the Director General exceeded his approval threshold for both capital and recurrent expenditure. Withholding and Value Added Taxes accruable to government for contracts executed were not remitted to FIRS; thus, resulting to loss of revenue by Government in violation of Section 16 (1&2) of National Emergency Management Act CAP N34 LFN 2004.”

Although the Vice President has denied any links to the fraud and stated that it queried the Director General of NEMA, Engr. Mustapha Maihaji, at the time,  the House of Representatives had insisted that Osinbajo had case to answer in the matter.

However, chairman of the investigative committee, Ali Isa, PDP, Gombe, submitted that being the chairman of the governing board of NEMA and approving authority at the time, Prof. Osinbajo might have questions to answer. “There is nowhere in my report where I mentioned the Vice President or Prof. Yemi Osinbajo but he may have questions to answer as the chairman of the governing board,” he explained.

Lagos____ A chieftain of the Yoruba apex socio-cultural organization, Afenifere, Chief Ayo Adebanjo, has noted that constitutional crisis in Nigeria and the imbalance in the polity are the main cause of agitation for a break-up by different groups in the country.

The lawyer and elder statesman said that it would be better if the country breaks up since the leaders refuse to restructure it.


According to him, “I have no objection to breaking up. People are talking of breaking up because the term of coming together has been abrogated by the northern Muslims who are dominating us,” he was quoted by Sun.

This is why the young elements, extremists in the South- East, South – South, South –West and the Middle Belt are yearning for break-up just because of their refusal to yield to our demand of peaceful co-existence.

On the recently reported crisis in the Presidency and the news of Vice president, Prof Yemi Osinbajo falling out of favour with President Muhammadu Buhari, the elder statesman blamed the constitution for the President’s action.


According to him, “It is just what I have said earlier. They are the people who aided and abetted the implementation of the wrong constitution because they give them the crumbs of the power. It is this constitution that empowers the president to make the vice president a market master. Whatever you are doing, the bottom line is the constitution.

If it is not this constitution, would the president be doing all that; is it not the constitution that gives him all the powers; a constitution that makes him the most powerful head of state in the whole world.

I have said it several times and I’m repeating it, we said it should be changed, but you say, no. This is not the constitution the founding fathers of the nation gave us.


I say it again, the constitution that Azikiwe, Awolowo and Ahmadu Bello gave us is what we want to return to, and I have challenged him whether he is more intelligent than Sardauna, but he has not answered.

Is he telling us that the constitution that Sardauna gave us is a wrong constitution, Sardauna was not as intelligent as he is now; or he is a more northerner than former premier or a more Muslim than the late premier?

It was the constitution that they all agreed to live in peace and that was after a crisis in the country, leading the colonial office to draw all the leaders to London.

Abuja____ The House of Representatives has accused Vice President Yemi Osinbajo of illegally approving the release of the sum of N5, 865, 671, 939.26 in June 2017 from the Consolidated Revenue Fund Account to the National Emergency Management Agency (NEMA).

This was contained in a report released on Thursday by the House Committee on NEMA.

The report, whose recommendations were based on findings from a thorough investigation by the Hon Ali Isa J.C House Committee on Emergency and Disaster Preparedness, was adopted by the lawmakers.

The House noted that the authorisation of the release of the fund for emergency food intervention of food security in the North East contravenes Section 80(4) of the 1999 Constitution as amended states that, “No money shall be withdrawn from the Consolidated Revenue Fund or any other public fund of the federation, except in the manner prescribed by the National Assembly”.

Similarly, it also breached the provision that the National Assembly must approve all issuance of Euro Bond from which the minister of Finance and the Accountant General of the Federation directed the Central Bank of Nigeria to pay from.

The funds were paid as follows for supply of food items: Dangote Rice Ltd N936, 196, 800; Golden Agric Input Ltd N1, 384, 554, 236; BUA Rice Ltd N1, 322, 273, 520; WACOT Ltd N453, 674, 296; WACOT Ltd N939, 946, 089; NEMA N829, 026, 456.

The lawmakers agreed that the authorization granted for the withdrawal of such huge sum of money from the Consolidated Revenue Fund Account was highly flawed and had infractions on Section 80(2) of the Constitution and Section (2) of the Procurement Act, as well as provisions of the Appropriation Act, did not follow due process as taxes and interest accruable to the government were not deducted or remitted to FIRS and no meeting held by the Federal Executive Council to approve the contracts.

Furthermore, the funds were credited directly to the individual banks of the companies and NEMA bank account, a violation of the approval limit allowed by law. Out of the N5.8 billion, NEMA got N829, 026, 456 for logistics and claimed it spent N369.5 million on general logistics, N189 million on branding and packaging, N248.6 million on branding and packaging and N21.9 million on contingency.

They, therefore, called for the dismissal and prosecution of the director general of NEMA, Engr Mustapha Maihaja over fraud, corruption and embezzlement of N33 billion Emergency Intervention Fund, as well as all the government officials involved in the approval, processing, release and diversion of the fund; that the Central Bank of Nigeria, being a banker to the federal government should not have been involved in giving loans to private companies and as such, should be investigated for the N2 billion loan said to have been given to four named companies.

The Committee’s investigation into Breach of Trust In NEMA covered the following aspects:

(1) Release of N5, 865, 671, 389 and N3, 153, 000, 000. 00 emergency food intervention of food security in the North East in 2017 (2)6, 779 metric tonnes of rice donated by the Chinese government to IDPs in the North East (3)Payment of about N800 million demurrage on the donated rice (4) over 10 billion naira, being 20 percent statutory ecological funds released between January 2017 to February 2018 to NEMA (5)Federal Government’s N1, 600, 000, 000to 16 states in July 2017 for Flood intervention(6) Over N1.6 billion released to NEMA for evacuation of Nigerians stranded in Libya in 2017 and other ancilliary issues; N33 billion naira was lost by the federal government due to Maihaja’s mismanagement and outright embezzlement of funds. The House, therefore, asked President Muhammadu Buhari to relieve the director general of NEMA of his duties and hand him over to relevant authorities for prosecution.

They also called on the relevant agencies to conduct further investigation on NEMA, Ministry of Agriculture and Ministry of Budget and National Planning in order for them to account for the 6, 779 metric tonnes of rice donated by the Chinese government  for the benefit of IDPs in Nigeria but was never received by the beneficiaries and prosecute all found wanting, recover the multiple transaction of N800 million demurrage from the ministry of Budget and National Planning, Ministry of Agriculture and NEMA and that the six staff of NEMA who were suspended for their testimonies before the investigative committee be reinstated.

On the issue of receipt and utilisation ofN1.6 billion for flood victims in 16 states, the House Condemned the display of insensitivity to the plight of flood victims showed by NEMA management in the handling of the relief materials and called on ICPC and EFCC to further investigate the matter and recover the sum of N700m from the director general of NEMA, who is the accounting officer of the agency.

REPORT OF INVESTIGATIVE HEARING ON THE VIOLATION OF PUBLIC TRUST IN THE NATIONAL EMERGENCY MANAGEMENT AGENCY (NEMA) SUBMITTED BY THE HOUSE COMMITTEE ON EMERGENCY AND DISASTER PREPAREDNESS.  HR 52/2018

1.0   PREAMBLE

The House of Representatives in Plenary on Thursday, 15th February, 2018, mandated the Committee on Emergency and Disaster Preparedness to investigate the alleged “Violation of Public Trust in National Emergency Management Agency (NEMA)” and report back to it for further legislative consideration.

In furtherance to the above Resolution contained in the Votes and Proceedings of the House, dated 15th February, 2018, the Committee adopted the following terms of reference to determine the propriety or otherwise of the transactions undertaken and expenditures incurred in the following areas of concern by management of NEMA.

(i) The release of N5,865,671,389.26 and N3,153,000,000.00 as emergency intervention of Food Security to support the population affected by insurgency in the North-East in June 2017 and other releases for the North-East intervention;

(ii) The 6,779 metric tons of rice donated by Chinese government to the internally displaced persons in the North-East;

(iii) Payment of about N800 Million Demurrage on the donated Rice by the Chinese government;

(iiii) Over 10 Billion Naira being statutory 20% Ecological Funds released between January 2017 to February 2018 to NEMA;

(v) The Federal Government of Nigeria Flood Intervention in the sum of N1,600,000,000.00 to 16 States in July 2017;

(vi) The over N1.6 Billion released to NEMA for Evacuation of Nigerians stranded in Libya in 2017; and

(vii) Other ancillary issues.

2.0 MODUS OPERANDI

The Committee took the following legislative measures in the course of discharging this assignment:-

(i) The Committee held number of meetings to determine its modus operandi;

(ii) Letters were written to critical stakeholders to elicit their views on the issue under investigation;

(iii) Committee placed adverts in both Print and Electronic Media soliciting for memorandum and sensitizing the Public and stakeholders to the Public Hearing to ensure overall success of the investigation;

(iiii) All submissions/documents received at the hearing were objectively scrutinized and analysed for informed findings and recommendations to the House for adoption.

3.0 INVESTIGATIVE PUBLIC HEARING

The Committee conducted investigative hearing on the matter.  The well-attended hearing was officially declared open on Wednesday, 21st March, 2018, by His Excellency, the Honourable Speaker of the House of Representatives, Rt. 4.0 ANALYSIS OF THE SUBMISSIONS

5.0 OBSERVATIONS/FINDINGS

A. DONATION OF 6,779 METRIC TONS OF RICE BY CHINESE GOVERNMENT FOR IDP’S IN THE NORTH EAST.

Committee appraised the submissions made by stakeholders involved in the matter and observed as follows:

– That the Chinese government donated and shipped a total of 6,779 metric tons of rice, that is 271 trucks and approximately 162,696 bags of rice into the country’s seaport in June 2017 meant for distribution to IDPs in the North-East as food assistance.

–   That the government Agencies namely – Ministry of Budget and National Planning, Ministry of Agriculture, Ministry of Finance and NEMA were charged with different responsibilities of receiving, clearing, storage, transportation and distribution of the consignments to the IDP’s in the North East.

–     That more than one year after the goods were donated, there is no evidence that the 6 States of the North East, who are the beneficiaries have received the items.

–   Evaluation of the correspondences by the Chinese government on the free donation of the items and responses by the Federal government Agencies confirmed that there was adequate information on the donation, as an Memorandum of Understanding (MOU) was entered into by all the parties indicating the role to be played by each Agency. But the rice could not be evacuated over long period of time at the seaport despite written letters by Chinese Government to Ministry of Budget and National Planning after an import waiver had been obtained from Ministry of Finance, informing the Nigerian authorities of the consequences of the delay in clearing the items.

–   The Federal Government paid about N800 Million as demurrage to APM terminal and Maersk Line for the consignment due to delay arising from inability and negligence on part of NEMA, Ministry of Agriculture, Ministry of Finance and Ministry of Budget and National Planning to secure the items as at when due.

–     APM Terminal provided invoices on the demurrage showing payment by Ministry of Agriculture but NEMA testified it made the payment. NEMA could not however, provide before the Committee evidence of payment to APM terminal but the payment reflected in their account book.

–     Ministry of Budget and National Planning was to provide the funding for the clearing, transportation of the rice, handling and logistic charges as agreed in the Memorandum of Understanding signed by the Government Agencies.

–     Ministry of Agriculture was responsible for providing silos for the storage of the rice.

–   The Ministry of Agriculture confirmed to the Committee that no single bag of the consignments was delivered and received from NEMA as at the time of this report.

–     Global View Logistics Ltd and Baltic Air and Maritime Services Ltd engaged to clear the rice were not registered contractors with NEMA, the Companies were equally not registered with ITF, NSITF, and PENCOM, as required by existing law, practice and Regulations.

–     National Emergency Management Agency (NEMA) was saddled with the responsibility of delivering the consignments to different designated silos and to distribute all the 6779 metric tons of the Chinese rice to the IDPs within the 6 States in the North-East in the following proportion:

Ministry of Finance provided Certificate for Import tax waiver with tax deduction on the consignments donated to Nigeria by Chinese government

The 5 State governments in the North-East except Borno State who did not appear before Committee, denied receiving any single bag of rice from the consignment purported to have been delivered and distributed to the IDPs by NEMA.

–   Due to the testimony of the Director of Finance and Accounts (DFA) and some staff of NEMA on payment of demurrage which the management was not comfortable with, NEMA management hurriedly convened a Governing Council meeting of NEMA for the first time in 3 years where it took a decision to suspend the Director of Finance and 5 other staff of the Agency without due process and in flagrant violation of the principle of fair hearing as guaranteed under Section 36 of the 1999 Constitution as amended.

–   The suspension took place on 2nd April, 2018 which was the date of the inauguration of the Council Members by the Vice President. This was done within the period of investigation by the Committee, and intended to jeopardise and obstruct the work of the Committee.

B. RECEIPT AND UTILIZATION OF N1.6BILLION FOR FLOOD VICTIMS IN 16 STATES

FINDINGS:

–     NEMA confirmed receiving the sum of N1.6 Billion released to it by the Federal Government as Intervention Fund to purchase food items and other relief materials for distribution to all the 16 States which was affected by the flood disaster in June 2017. The States are: Lagos, Oyo, Edo, Kwara, Ebonyi, Niger, Ekiti, Kebbi, Akwa Ibom, Plateau, Sokoto, Bayelsa, Enugu, Ondo, Abia State and FCT

–     The ratio of distribution of the fund for each State is N100,000,000.00.

– The Committee further confirmed that 11 of the States received relief items worth less than N50,000,000.00 each while 5 States received items worth N70,000,000.00 each from NEMA and only received the items in March 2018 when the investigative hearing commenced.

–     The relief materials released was an afterthought and not intended to salvage the situation as the disbursement happened 9 months after the flood disaster. Thereby defeating the emergency purpose for which it was meant.

–   NEMA could only account for the disbursement of N900 Million to the Sixteen States.  The balance of N700 Million could not be accounted for.

C. FUNDS RELEASED FOR EMERGENCY INTERVENTION OF FOOD  SECURITY IN THE NORTH-EAST

FINDINGS:

–     On the emergency intervention of food security to the North-East to support the population ravaged by insurgency, a sum of N5,865,671,939.26 was approved and released in June 2017 vide a memo raised from the Office of the Acting President, directing the Hon. Minister of Finance and the Accountant General of the Federation to so act.

The details further specified a directive to the Governor of CBN from the Ministry of Finance to pay the sum from theConsolidated Revenue Fund Account which the AGF is to raise a mandate for.This is in contravention of approval of NASS on the issuance of Euro Bond from which the Hon. Minister authorized the payment. The Euro Bond is for specified infrastructural projects and not for discretionary intervention.

Furthermore, there is no specific appropriation by the National Assembly.

This contravenes Section 80 (4) of the 1999 constitution as amended: which states:

“No money shall be withdrawn from the Consolidated Revenue Fund or any other public fund of the Federation, except in the manner prescribed by the National Assembly”.

The money was paid to the following companies for supply of food items to the North East:-

1. Dangote Rice Ltd. = N936,196,800.00

2. Golden Agric Input Ltd. = N1,384,554,236.26

3. BUA Rice Ltd. = N1,322,273,520.00

4. WACOT Ltd. = N453,674,296.00

5. WACOT Ltd = N939,946,089.00

6. NEMA = N829,026,456.00

= N5,865,671,389.26

–     Committee noted the flaws and infractions on the authorization granted and removal of such huge sum of money from the Consolidated Revenue Fund Account of the Federation in violation of section 80(2) of the Constitution, Section 16(2) of the Procurement Act and provisions of the Appropriation Act as approval of the Legislature was not sought nor obtained for such expenditure.

–   Due process was not followed as taxes and interest accruable to government were not deducted and remitted to the FIRS on the sums released and paid into the accounts of the different corporate entities shown above, this created colossal loss of revenue to the Federal Government.

No meeting of the Federal Executive Council was held approving the contracts to the named companies and the release and crediting of the funds directly into the individual companies and NEMA bank account in blatant violation of approval limit allowed by law.

–   It was revealed in the Public Hearing testimonies that Dangote Rice Ltd, WACOT Ltd, BUA Rice Ltd and Golden Agric Input Ltd had earlier received N2billion each from CBN as loan to mop up grains across the country.

– All the 6 States of the North East denied ever receiving this emergency intervention for food security in the North East for which about N5.8b was expended by the Federal Government.

–   Out of about N5.8Billion. NEMA got N829,026,456 for logistics and it claimed it spent it as follows, without satisfactory evidence:

(i) General Logistic N369.5 million

(ii) Branding and packaging N189.00 million

(iii) Others (Marketing, Security, tracking and media) N248.6 million

(iiii) Contingency N21.9 million

D. RELEASE OF N3,153,000,000.00 TO NEMA FOR FOOD INTERVENTION TO THE NORTH-EAST

FINDING:

–   The Committee noted that NEMA released 2.4 Billion Naira to Olam Nigeria Limited to supply 8,000 metric tons of rice, gave 3 Brother Rice MillLimited the contract to supply 2,000 metric tons of rice at N600,000,000 and N153,160,000 for logistics and transportation of the items, all totaling N3,153,000,000.00.

–     Committee observed that OlamNigeria Limited and 3 Brother Rice MillLimited were contacted verbally by Ministry of Agriculture to go to NEMA for the jobs without due process.

–   The contract award letters issued toOlam Nigeria Limited and 3 Brothers Rice Ltd were all signed by the Ag. Director of Relief and Rehabilitation and not by Director of Procurement in contravention of Public Procurement Act.

–   The same Ag. Director of Relief and Rehabilitation who was saddled with the responsibilities of receiving the items and distributing them, signed the award letters without the knowledge of the Procurement Department. This is tantamount to breach of the Procurement Act.

– Evidence before the Committee showed that the World Food Programme (WFP) sought to import and supply 5000 metric tons of rice to the North East, at the rate of N11,500 per bag which is cheaper than the N15,000 per bag offered by local Nigerian millers. However, the Committees findings indicate that the concerned Federal Government agencies namely Federal Ministry of Agriculture and NEMA offered to subsidise the purchase locally, at the same rate of N11,500 to World Food Programme to discourage importation and encourage local production.

– NEMA now claimed to have donated the 5000 metric tons of rice to WFP  instead of allowing WFP to purchase same and distribute to the North East. There is no evidence that the WFP received the 5000 metric tons as donation from NEMA, as the approval of N3.1billion was for NEMA to purchase the rice and distribute same to the victims of insurgency in the North East, as WFP did not provide the Committee with such evidence after repeated requests.

– Both companies, Olam Nigeria Ltd and 3 Brothers Rice Mill Ltd, were illegally contracted to carry out the supplies as their profiles showed that they had no PENCOM, FIRS, ITF and NSITF Clearance Certificates in compliance to Section 16 of the Public Procurement Act.

–   The data of 3 Brothers Rice Ltd sighted by the Committee did not tally with registration name “Three Brothers Rice Mill Ltd” approved by Corporate Affairs Commission which means NEMA gave contract to a non-existent entity.

Therefore the contract awarded to both Olam and 3 Brothers were in violation of the Procurement Act.

E.   EVACUATION OF NIGERIANS FROM LIBYA

FINDINGS

– Committee confirmed that the sum of N1.6Billion was released to NEMA for the evacuation of Nigerians stranded in Libya in year 2017.

– The Committee also discovered that contract awarded under this exercise were inflated.

– In the course of the investigations, the Director-General of NEMA, Eng. Mustapha Yunusa Maihaja, gives account of expenditure as the N1.6Billion to include evacuations, security personnel logistics and local transport.

F. UNACCOUNTED N17,889,050,401 RELEASED FROM ECOLOGICAL FUND TO NEMA

FINDINGS

– The Committee established that 20% of the Statutory Ecological funds are released to the National Emergency Management Agency on monthly basis. This is in compliance with Section 13(2B) of the NEMA Act.

– It was discovered that from January 2017 to May 2018 the total amount released and or received by NEMA is to the tune of N17Billion.

– Furthermore, NEMA incurs expenditure from the fund without going through statutory appropriation approval from the Legislative Arm of Government.

– The Committee noted that the failure of the Governing Council of NEMA to forward the details of the amount released to it to the National Assembly for Appropriation, consideration by the Legislature and passage is a gross violation of the provisions of the Constitution.

– Due process was also not followed by NEMA on the contract sums as the Director General exceeded his approval threshold for both capital and recurrent expenditure. Withholding and Value Added Taxes accruable to government for contracts executed were not remitted to FIRS; thus, resulting to loss of revenue by Government in violation of Section 16 (1&2) of National Emergency Management Act CAP N34 LFN 2004.

6. RECOMMENDATIONS:

1. On the issue of donation of 6,779 metric tons of rice by Chinese Government for IDP’s in the North East, the Committee recommends as follows:

(i.) that the House condemns in strong terms the negligence and inefficiency of the Ministry of Budget and National Planning and National Emergency Management Agency (NEMA) for the long delay in collection of the donated rice from the Port Terminal.

(ii)   that NEMA and the Federal Ministry of Agriculture, Ministry of Budget and National Planning should account for the 6,779 Metric tons of Rice donated to Nigeria Government for the benefit of IDP’s in the 6 States of the North East by the Chinese Government but was never received by the beneficiaries. The ICPC, EFCC and Nigeria Police Force (Police) should conduct further investigation and prosecute where necessary.

(iii) that the ICPC, EFCC and Police should ensure recovery of the payment of about N800m demurrage from the concerned officers of the Ministry of Budget and National Planning, Ministry of Agriculture and NEMA. They should further investigate the conflicting testimonies of the above agencies and determine whether there was multiple payment transaction for the demurrage.

(iv) that the suspension of six staff of NEMA by its management is an abuse of power, against the extant public service rules and a gross violation of Section 36 of the 1999 Constitution as amended. It is also a privileged communication under the Legislative Houses (Powers and Privileges) Act, any person that obstructs a witness before a legislative House is also guilty of contempt of parliament.

(v)   It is therefore hereby recommended that the affected staff below be immediately re-instated by NEMA and the appropriate authorities and all their arrears of entitlements paid. They are:

1.  Mr.  Akinbola Hakeem – Director, Finance and Accounts

2.  Alhassan Nuhu    –      Director Disaster & Risk Reduction

3.  Mr. Emenike Umesi    – Ag. Director, Special Duties

4.  Mohammed Kanar    –      Deputy Director Welfare

5.  Mr. Mamman Ibrahim    – DD Captain of the Air Ambulance

6.  Yunusa Deji Ganiyu    –   Asst. Chief Administrative Officer

2. On the issue of receipt and utilization of N1.6 billion for flood victims in 16 states, the Committee recommends;

(i.) that the House condemns in its entirety the display of insensitivity to the plight of flood victims showed by NEMA management in the handling of the relief materials.

(ii)   that the ICPC and EFCC should further investigate the matter and recover the sum of N700m from the Director-General of NEMA, Engr. Mustapha Yunusa Maihaja.

Lagos_____ There is intense pressure on Vice President Yemi Osinbajo to resign his position with immediate effect, Daily Independent has exclusively gathered.

Sources close to the vice president said since the latest developments in the presidency started, he has received calls from his mentors and loyalists within the ruling All Progressives Congress (APC) to quit his position if he realises “the current developments in the presidency are attempts to humiliate him.

Since these developments started, a lot of concerned Nigerians have expressed their concern that the vice president should resign in order to avoid further humiliation. I think that is the intention of those behind the plot too.

They want to frustrate him into quitting but I don’t think he (Osinbajo) will do that, at least not for now”, a credible source in the presidency said.
Trouble began last month when the Chief of Staff, Abba Kyari, issued a memo to Babatunde Fowler, chairman of the Federal Inland Revenue Service (FIRS), requesting him to account for significant variances in the budgeted collections and actual collections by the agency.

Though Fowler, who is a long standing associate of Osinbajo, replied the memo, many believed it was attempt by the presidency not to renew his term. Also, President Muhammadu Buhari directed his new ministers to channel all requests for meetings with him through his Chief of Staff, Abba Kyari. Many Nigerians kicked against the move, saying that should have been delegated to Osinbajo, who is the number two man in the government.

On Monday, President Buhari dissolved the Economic Management Team (EMT) headed by Osinbajo and raised another, the Economic Advisory Council (EAC).
The new EAC, which reports directly to the president, will be chaired by an economist, Prof. Doyin Salami.

While Osinbajo has no role in the new economic team, it was also gathered that he may no longer be in charge of the Social Investment Programmes (SIPs) of the current administration, as the TraderMoni and other SIPs will now be handled by the new Ministry of Humanitarian Affairs.

Another presidency source also confirmed that the staff of the vice president will be reduced in the days ahead “in a cost cutting measure”. A lot of political analysts have said the latest move is targeted at whittling Osinbajo’s powers ahead of the 2023 presidential election as the cabal in the presidency is scheming towards retaining power in the North after President Buhari may have completed his eight years rule.

However, the presidency has kept mum on the issue and efforts made to speak with media aides of the president and some leaders of the APC proved abortive as they declined to speak on the matter.
Speaking on the latest developments, Prof. Itse Sagay (SAN), chairman of the Presidential Advisory Committee Against Corruption (PACAC), said the setting up of the Economic Advisory team will not in any way reduce Osinbajo’s powers.

Honestly, I don’t see the development in that light. There should be an independent Economic Management team who are economic advisers to the president, it has always been like that. What Osinbajo is doing, his job under the constitution, is chairman of National Economic Council which involves all the governors of the states.

This new one that was established is to ensure that there is no lacuna. This one is a policy-framing body, they frame policy and recommend to the government. I think that will not affect Osinbajo’s day-to-day responsibilities as head of the Nigerian Economic Council which has a lot of work on implementing policies at the federal and state level.

My view is that this new group will strengthen Nigeria’s economic power house and capacity to meet our national challenges. It does not remove anything from Osinbajo. He still retains all his constitutional authorities as the chairman of his economic body”, Sagay said.
On his part, Junaid Mohammed, a Second Republic lawmaker, said while there is no rift between Osinbajo and Buhari, loyalists of the vice president should desist from raising false alarm where there is none.

Osinbajo has performed for the country and for Buhari because of the president’s physical infirmity since he became president. Osinbajo could not have carried out those roles without the permission and authority of the president, his boss. If there is anything wrong in the course of doing his job, it is the responsibility of the president and not the media to call him to order.

If the two most important people in the country have a problem between themselves which I don’t believe they have, it is the duty of the party to resolve any issues they have. But of course, I am aware that some people who claim to be close to Osinbajo are busy raising false alarm which does not exists,” he said.

Former Vice President and Chieftain of All Progressives Congress (APC), Atiku Abubakar, took on his critics yesterday, asking them to provide proof of allegations of corruption against him.

“If anyone has evidence against me, tender it now or shut up forever,” Mr. Atiku told his critics.

In a statement issued in Abuja, Atiku advised his self-righteous political enemies to either prove his alleged corrupt activities or mind the skeletons in their own closets and keep quiet.

He also said he would fight corruption like never before if he was given the opportunity to preside over the affairs of the country.

The statement said Atiku spoke during a facility tour of the new ultra-modern Yaliam Press Limited in Jabi Area of Abuja.

“It is sickening to continue to regurgitate allegations of corruption against me by people who have failed to come forward with a single shred of evidence of my misconduct while in office," he said.

“People who have no initiative, personal resourcefulness, and ideas about wealth creation, always assume that a man cannot build himself without stealing."

“People who are bereft of ideas about entrepreneurial spirit always think that everyone else is a thief like them.”

He added that it was morally offensive for people who despised honest labor to become judges in the courts of public opinion.

The Waziri Adamawa explained that though he had not been convicted of corruption by any court in the land or elsewhere, his political enemies had been parading a fake morality to fool gullible Nigerians.

“Despite previous desperate efforts to link me with corruption, the William Jefferson trial in the United States ended in 2009 without indicting me or linking me to corrupt activities,” he said.

Atiku, who was responding to the welcome address by the Chairman/CEO of Yaliam Press Limited, Yahaya Ali Amfani, recalled that he posted a reminder at his bed rest during his training as a Customs officer that he (Atiku) would retire from any agency if he had not attained the headship of the place at the age of 40.

Atiku said that he was only able to attain the position of deputy director before his exit in 1989 to chart a career in business. Atiku told the management and staff of Yaliam Press that he retired from the Customs service with an untainted record, stressing that if anybody had evidence that he stole a kobo at the Customs or during his tenure as Vice President, such accusers should come forward or file a petition against him.

Atiku said he didn’t become a vice president in 1999 as a pauper, noting that he had been a successful investor throughout his retirement life.

“If Atiku is a thief merely because of his resourcefulness and successful investments, my political enemies should tell Nigerians the sources of their own stupendous wealth,” he added.

......Do you think Niger Delta struggle has paid off?

.......Take a deep breathe, close your eyes and reflect, you will see the realities of the scrimmage.


When I hear some guys flaunt "I'm son of the struggle", "we are the front runners of the struggle ", "we are the stakeholders of Niger Delta struggle", "we are the foot soldiers, the gun runners" among others, I shook my head and walk away.

If I may ask, where are the developments in Niger Delta Region most especially the ijaw communities? Where are the well equipped schools, skill centers, good drinking water, electricity, etc. Suffice to say that there is no tangible developmental strides feasible in the region.

In case we have forgotten, the Niger Delta agitation was anchored on the issues of marginalization, environmental despoliation, development and infrastructural decay, and poverty amidst plenty. But what have we achieved in the struggle? If not that we have achieved making few personalities billionaires in the region, who are now fighting back, to suppress the cry of the impoverished plenty unjustly. Is that what we bargained for the struggle encompassing over 45 million people?

Stop ranting, put your head up and cogitate. Oil (light) is flowing under our houses, threatening our peaceful existence yet the darkest it has become. No gas light.... Was darkness part of the bargain?

To be candid, the Niger Delta struggle has led to the creation of some interventionist agencies. Viz: Niger Delta Development Commission NDDC, Ministry of Niger Delta Affairs, 13% derivation, Niger Delta Basin Development Authority, Presidential Amnesty Programme PAP. The question is, are the people feeling the impact of those agencies? NO! Rather than hasten development in the region, interventionist efforts in the Niger Delta have become a veritable means of corrupt enrichment of individuals, making it evident that the well intentioned efforts of the struggle have been rendered counterproductive.

It is regrettable to note that, the interventionist commissions most times originate and award contracts without due diligence to ascertain the capacity and competence of the contractors; nor were there adequate budgetary provisions to ensure that the projects were executed to completion. When contracts are awarded without the requisite supervision, it is clearly evident that they were not designed to produce any desired result, but merely to reward political associates, hirelings, vocal local critics or even warlords that needed to be silenced. Uncompleted projects everywhere... Is that part of our bargain? Where is now the succour for our people?

The Niger Delta Basin Development Authority is  a service oriented organization that is positioned  to meet the  water requirements of stakeholders in the most satisfactory  and coefficient manner, while ensuring good quality and sanitation and paying adequate attention to the preservation of the ecosystem, using proven technology and a well motivated workforce. But where are the good drinking water today? There is no gainsaying that 13% derivation is a product 87% deprivation? Because the derivation so far has no positive impact in our people.

Nothing is just working! The points of agitation has not change after these many years. Can we continue like this? There is a saying thus; if you want to develop the people develop/enable the environment. In developed countries or cities like Abuja, only the environment can make you live a fulfilled life. All of these not feasible in the Niger Delta region. The Presidential Amnesty Programme is another scam used to enrich few people in the Niger Delta. They send ex agitators to schools home and abroad, came back to meet the same polluted, underdeveloped environment. Most of which are now Facebook lawyers, activists, just to keep body, soul together. Is this our bargain? Even the #65,000 monthly stipend Stipend has further enslaved our youths... Tell me who is doing well with the 65k, as commensurate to what feeds this nation? They are always broke and borrow to survive with their families because 65k can't stand the high prices of commodities in the market.

The most unfortunate was our supposed Messiah Dr. Goodluck Ebele Jonathan who go to Aso Rock as president of this country, surround himself with his likes and  returned home with one of the most prestigious awards "Peace Ambassador of Nigeria" indeed. An award that cannot construct road to his country home, and other communities. He Voluntarily willed our opportunity away, pursuing for second term that was a mirage.

The few schools sited in the Niger Delta region are under equipped. Who us this thing?

Don't misconstrue me of inciting the public. It's my own way expressing myself. I only want to let my people know that the Niger struggle hasn't paid off as demanded. They promised to turn our communities to Dubai, but not kept.

If care is not taking, time is coming when Niger Delta will wage war against Niger Delta! The impoverished plenty against the enriched few! Where leaders will be quizzed to answer questions, how effective they have used the interventionist agencies to impact lives of people in the Niger Delta region.

It is my passionate appeal that those Manning the interventionist agencies should properly channel our resources towards developing the region. If not the sustainable peace might not stand the test of time.
